WHAT IS THE DPML?
THE DOMAINS PROTECTED MARKS LIST (DPML) HAS BEEN INTRODUCED BY THE REGISTRIES DONUTS, RIGHTSIDE AND MINDS + MACHINES. THESE THREE REGISTRY OPERATORS WILL COLLECTIVELY LAUNCH OVER 250 NEW GENERIC TOP LEVEL DOMAINS (GTLDs), SUCH AS .BUSINESS, .EMAIL AND .SERVICES.
The DPML prevents cybersquatting by enabling trademark owners to block their trademarks from registration across the three registry operators.
HOW DOES IT WORK?
DPML WORKS BY “BLOCKING” TRADEMARK RELATED TERMS FROM REGISTRATION (THE CHARACTERS BEFORE THE DOT). A DPML TERM IS BLOCKED WITHIN ALL THE TLDs LISTED HERE.
A separate block is required for each TLD operator.
EXAMPLE: Microsoft owns the trademark ‘xbox’. Microsoft can purchase a DPML Block for ‘xboxx’ because it fully contains their trademarked term ‘xbox’.
THE TRADEMARK MUST BE VALIDATED WITH THE TRADEMARK CLEARINGHOUSE (“TMCH”) AND REMAIN VALID FOR THE DURATION OF THE DPML SUBSCRIPTION . THE TMCH IS ICANN’S CENTRALIZED TRADEMARK DATABASE.
When a trademark is validated the TMCH issues a SMD file (a unique code), which is used to block that specific mark with the specific TLD operator.
INITIAL SUBSCRIPTION = 5 YEARS.
RENEWALS ARE AVAILABLE FOR 1 TO 10 YEARS.
WHAT IS PROTECTED?
DPML allows trademark owners to protect more than simply the identical trademark. It also allows for the protection of keywords that contain the mark (minimum three characters).
Each selected DPML term requires its own separate subscription, e.g. a block subscription for Yahoo will only block the identical term. To block the term “yahoosearch”, a separate subscription block will need to be purchased. See the various forms of protection in the table below:
CAN BLOCKED DOMAINS BE USED?
NO, A BLOCKED DOMAIN IS NON-FUNCTIONAL, MEANING IT MAY NOT BE USED FOR A WEBSITE URL, EMAIL ADDRESS OR OTHER DOMAIN RELATED FUNCTIONS.
CAN I REMOVE A BLOCK FOR A SPECIFIC TLD?
YES, YOU WILL RETAIN THE ABILITY TO REGISTER SPECIFIC DOMAINS DURING OR AFTER THE “SUNRISE” PERIOD. THE “SUNRISE” IS THE PRIORITY PERIOD OF A NEW GTLD DURING WHICH REGISTRATIONS ARE AVAILABLE ONLY TO TRADEMARK RIGHTS HOLDERS.
A DPML block on a specific domain may be overridden and the corresponding domain registered by a trademark owner with Sunrise rights to that domain. An override can be performed at any time and can be initiated by the owner of the DPML account or by another trademark owner. The party requesting the override must have an exact match, Sunrise eligible trademark for the domain.
EXAMPLE: ACME Manufacturing subscribes to DPML to block its trademarked ACME term. ACME Plumbing, which owns a trademark that contains the ACME term and is eligible to register domain names during Sunrise, may override the DPML block and register acme.plumbing.
WHAT DOMAINS CANNOT BE BLOCKED?
* DOMAIN NAMES ALREADY REGISTERED
A DPML subscription does not block a term in a TLD that was registered prior to the DPML subscription. If a previously registered domain expires or is deleted, DPML protection will then automatically apply to that TLD.
* 1 AND 2 CHARACTER TERMS
Three character terms are permitted but only as an exact match of the trademark.
* MISSPELLINGS OF THE TRADEMARKED TERM
* PREMIUM DOMAINS
In Donuts and Rightside TLDs, most domains are priced as standard. However, there will be a limited number of higher priced premium names, which are ineligible for DPML block. These premium names are always generic terms.
* OTHER SUNRISE RIGHTS
Another trademark holder with Sunrise rights for a term may register, at any time, that term as a domain, even when a DPML subscription exists for it.
If Delta Airlines places a DPML on the term ‘delta,’ another company — Delta Faucets, which also has a trademark for ‘delta’ may register the term in one or more blocked TLDs. This is known as an “override” and is consistent with the purpose of DPML — to lock cybersquatters and not legitimate mark owners.
