Paperless Inc is an American company that provides online and printed stationery, including greetings, invitations, birth announcements and custom stationery from its website www.paperlesspost.com. It has over the last few years become a leader in its industry.

Paperless Inc’s success has made its competitors pay attention with the result that one of them, EventKingdom GmbH, registered the domain name paperlesspost.eu (regional domain extension for the European Union). This was done to prevent Paperless Inc from using a domain name matching their trade mark under that .eu extension, in addition, the domain name was used to divert unsuspecting users to EventKingdom’s website in order to profit from that confusion.

In its decision, the ADR panelist found:

1. That the domain name Paperlesspost.eu was confusingly similar to a name is respect of which a right is recognised by Community Law. AND
2. EventKingdom was acting in bad faith, since EventKingdom had engaged in a pattern of conduct in registering a series of other domain names that directly related to the Paperless Inc’s trade marks.
