Lexsynergy recently recovered two .cn domains for The Standard Bank of South Africa Limited: stanbicibtcbank.cn and stanbic.com.cn. Recovering a domain in China can be difficult as there are unique rules and limitations. It is only possible to rely on the CN Domain Name Dispute Resolution Policy (cnDRP) if the disputed domain is less than two years old. After two years the recovery process will have to take place via the local Chinese legal system, which can be lengthy and expensive. Domain squatters are aware of these terms and will often register a domain, remain quiet for two years, and once the two-year mark has passed they will try to sell the domain to the trade mark owner.
Lexsynergy identified the above domain names within the two year period allowing our client to take advantage of the cnDRP. Lexsynergy also successfully argued for the complaint to be heard in English.
This case highlights the importance of monitoring the use of a trade mark in China and around the world so infringements can be identified and handled appropriately within sufficient time.
