Lexsynergy recently won two UDRP complaints to maintain our 100% success rate.
The first complaint was for the domain thinkmarketsfx.com on behalf of our client TF Global Markets. Lexsynergy provided evidence to the UDRP panel that the Respondent was not authorized to use TF Global Market’s trade mark “THINKMARKETS” and was not commonly known by the disputed domain. Additionally, the Respondent failed to use the disputed domain for legitimate use or in connection with a bona fide offering of goods or services. Rather, the disputed name resolved to a website impersonating TF Global Markets and appeared to be used for a phishing scheme.
The second complaint was for the domain bidvestgrouplimited.com on behalf of our client Bidvest Industrial Holdings. For this complaint, Lexsynergy showed that the Respondent had no rights or legitimate interests in the domain, was not commonly known by it and was not authorised by Bidvest to use their mark. The domain was being forwarded to Bidvest’s own corporate web site to confuse and deceive users and had been set up for email use opening up the possibility for phishing or fraud. The forwarding to the Bidvest’s website showed actual knowledge of Bidvest and its business.
In both complaints, the UDRP panel found that the disputed domains met all three requirements:
